What are Mediation and Arbitration?
Mediation is a form of alternative dispute resolution in which conflicting parties can settle their matters out of court with the assistance of a neutral, third party called a mediator. The mediator helps facilitate an agreement between the parties.
Arbitration is a form of alternative dispute resolution in which a dispute is presented to an independent arbitrator who makes a judgment on the case. It is different from mediation in that much less focus is on the parties resolving the matter themselves – the arbitrator acts much as a judge would in court.
There are many advantages of mediation and arbitration. Both forms of alternative dispute resolution offer parties a chance to settle their matters in private. Perhaps the greatest advantage of mediation and arbitration is that the costly process of litigation is avoided.

Scott Delius is a registered mediator with the Georgia Office of Dispute Resolution and has served successfully as a neutral for the DeKalb County State and Superior Courts in metropolitan Atlanta for many years.
